SurgeVita 12-Week Program Agreement

1. Program Description

SurgeVita, LLC ("SurgeVita," "we," "our," or "us") provides live transformation training programs delivered primarily through Zoom. This agreement governs participation in either of the following 12-week programs:

• Core Group Experience — a structured 12-week group program with weekly live sessions, guided assignments, and community accountability.
• Core 1:1 Experience — a structured 12-week private program with weekly individual sessions and personalized transformation work.

Both programs are led by Distinction Leaders and are designed to produce measurable personal transformation over the course of 12 weeks.

2. Payment Terms

You agree to pay the full program fee based on the program and payment option selected at registration.

Core Group Experience

• Pay in Full (PIF): $750 — one single upfront payment
• 3-Payment Plan: 3 payments of $350, automatically processed through Stripe

Core 1:1 Experience

• Pay in Full (PIF): $1,500 — one single upfront payment
• 3-Payment Plan: 3 payments of $600, automatically processed through Stripe

All payments are binding. By selecting a 3-Payment Plan, you agree to complete all three payments in full. Payments are automatically billed to the card provided during registration.

3. Missed or Failed Payments

If a payment fails, Stripe will automatically retry the charge. After two (2) missed payments, your program access may be paused until the account is brought current. Missed payments must be made up before sessions resume.

If payment is not completed within 14 days of a failed charge, the account may be sent to collections or permanently withdrawn from the program without refund.

4. Refund Policy

SurgeVita stands behind the transformation this program produces. If you complete the full program and are not satisfied with your experience, you may request a full refund within 7 days of your final session.

To qualify, the following conditions must be met based on your program:

Core Group Experience:

• You must have attended at least 11 of 12 scheduled sessions.
• Missing more than 1 session voids refund eligibility. You will be notified by your Distinction Leader or Program Support Specialist when eligibility is lost.
• Participants who miss 4 or more sessions will be removed from the program and are not eligible for a refund.
• Refund requests must be submitted to support@surgevita.com within 7 days of the final session.

Core 1:1 Experience:

• All 12 sessions must be completed before refund eligibility applies.
• A maximum of 2 reschedules are permitted for the full 12-week program.
• All reschedules must be communicated at least 24 hours in advance.
• No-shows or cancellations with less than 24 hours notice beyond the 2 permitted reschedules will be marked as completed sessions and void refund eligibility. You will be notified by your Distinction Leader or Program Support Specialist when eligibility is lost.
• Refund requests must be submitted to support@surgevita.com within 7 days of the final session.

Emergency Exceptions: Genuine emergencies affecting attendance or rescheduling will be reviewed on a case-by-case basis for both programs. Contact support@surgevita.com as soon as possible to notify the team.

Third-Party Financing: Payments made through any third-party financing service — whether officially supported by SurgeVita (such as Klarna) or independently arranged by the participant (such as PayPal Credit, Affirm, or any similar service) — are strictly ineligible for a refund. By using a third-party financing service, you agree to fulfill your obligations directly with that provider regardless of your participation or satisfaction with the program.

No Partial Refunds: No partial refunds, mid-program cancellations, or payment pauses will be issued under any circumstances.

5. Attendance and Accountability

You agree to attend all scheduled sessions or review session replays promptly. Active participation is required to receive full program benefits. Failure to attend does not release you from payment obligations.

6. Program Disclaimer

Results vary per individual. SurgeVita programs are transformation training experiences. They are not therapy, legal advice, or medical treatment. You are solely responsible for applying what you learn to your life.

6a. Mental Health and Medical Waiver

SurgeVita, LLC is a personal transformation training company. We are not a licensed mental health provider, medical institution, therapy practice, or counseling service. Nothing in this program constitutes or replaces therapy, psychiatric care, psychological counseling, or any form of medical treatment.

By enrolling, you acknowledge and agree to the following:

Not a Clinical Service. SurgeVita programs are personal development and transformation training experiences. Distinction Leaders are not licensed therapists, psychologists, psychiatrists, or medical professionals and do not operate in any clinical capacity.

Personal Responsibility. Participation in transformation work may surface emotional responses, personal insights, or challenging experiences. You are solely responsible for how you respond to and integrate the content of this program. SurgeVita and its representatives are not liable for any emotional, psychological, or physical responses that arise during or after your participation.

Existing Conditions. If you are currently receiving mental health treatment, psychiatric care, or medical care of any kind, it is your responsibility to consult your provider before enrolling. By registering, you confirm that you are either not under such care or have received clearance from your provider to participate.

Right to Refer. SurgeVita reserves the right to recommend that a participant seek professional mental health or medical support at any time during the program if deemed necessary in the judgment of the Distinction Leader or SurgeVita staff.

Right to Pause or End Participation. If SurgeVita reasonably determines that a participant's mental health or wellbeing requires it, SurgeVita reserves the right to pause or terminate a participant's enrollment. In such cases, refund eligibility will be reviewed on a case-by-case basis.

No Liability. To the fullest extent permitted by law, SurgeVita, LLC and its Distinction Leaders, staff, and representatives shall not be held liable for any mental health outcomes, emotional responses, psychological effects, or medical conditions arising from or related to participation in any SurgeVita program.

7. Conduct and Confidentiality

You agree to maintain professionalism and confidentiality within all sessions and group environments. SurgeVita reserves the right to remove any participant for disruptive, inappropriate, or unethical behavior without refund.

8. Third-Party Registration

If a third party (such as an employer or sponsor) registered and paid on your behalf, you as the participant are still individually bound by all terms in this agreement. By submitting this form, you confirm your personal agreement to these terms regardless of who made the payment.

9. Intellectual Property

All program content, materials, and session recordings remain the exclusive property of SurgeVita, LLC. You may not reproduce, distribute, or share any program materials without written permission from SurgeVita.

10. Limitation of Liability

To the fullest extent permitted by law, SurgeVita, LLC and its representatives shall not be liable for any indirect, incidental, or consequential damages arising from your participation in our programs.

11. Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict-of-law principles.

1. Event Description

The Breakthrough In event is a live online transformation experience hosted by SurgeVita, LLC ("SurgeVita," "we," "our," or "us") via Zoom. This event is open to all members of the Deaf community, including Deaf, hard of hearing, CODAs, ASL interpreters, and hearing people embedded in Deaf culture.

By registering for this event — whether at no cost or for a paid ticket — you agree to be bound by all terms in this agreement.

2. Ticket and Payment

Free Admission: No payment is required. Registration is your confirmation of attendance and agreement to these terms.

Paid Admission ($35): Payment is processed securely through Stripe at the time of registration. All paid tickets are strictly non-refundable. No exceptions will be made for no-shows, cancellations, or personal circumstances.

3. Zoom Link and Access Policy

The registration link and Zoom access provided upon registration are for the registered attendee only. You may not share, forward, or distribute the event link to any other person. Unauthorized attendees discovered during the event will be removed immediately.

SurgeVita is not responsible for any technical difficulties, connection issues, or platform outages experienced on the attendee's end. No refunds or compensation will be issued for technical issues outside of SurgeVita's control.

4. Age Requirement

This event is intended for participants who are 18 years of age or older. If you are under 18, you must have obtained written parental or guardian consent prior to registering. By registering, you confirm that you meet this requirement.

5. No Recording Policy

You may not record, screenshot, screen capture, or otherwise capture any portion of this event in any format — audio, video, or image — without prior written permission from SurgeVita, LLC.

This applies to all attendees regardless of admission type. Violation of this policy may result in immediate removal from the event and potential legal action.

6. Intellectual Property

All content presented during the Breakthrough In event — including distinctions, frameworks, language, exercises, and materials — is the exclusive intellectual property of SurgeVita, LLC. You may not reproduce, distribute, share, teach, or repurpose any content from this event without written permission from SurgeVita.

7. Conduct

You agree to maintain respectful and professional conduct throughout the event. SurgeVita reserves the right to remove any attendee for disruptive, inappropriate, or disrespectful behavior without refund or compensation.

8. Communications Consent

By registering for this event, you consent to receiving follow-up communications from SurgeVita related to the event and future programs. You may opt out of marketing or promotional emails at any time by clicking the unsubscribe link in any email or by contacting support@surgevita.com.

9. Program Disclaimer

The Breakthrough In event is a personal transformation experience. It is not therapy, medical treatment, legal advice, or clinical counseling. SurgeVita and its presenters are not licensed mental health or medical professionals. You are solely responsible for how you engage with and apply the content of this event.

10. Limitation of Liability

To the fullest extent permitted by law, SurgeVita, LLC and its representatives shall not be liable for any indirect, incidental, or consequential damages arising from your attendance or participation in this event.

11. Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict-of-law principles.
